These Terms of Use ("Terms") are between you ("User") and Schumann Resonance Live at schumannresonancelive.com. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
2. Eligibility
You must be at least 16 years old, or use under parental/guardian supervision and consent. You may not use the Site if prohibited by law or court order.
3. Description of Service
The Site provides informational Schumann resonance, space weather, and related frequency data: live charts, spectrograms, summaries, limited audio trial, and related content. Premium plans include advanced monitoring dashboards, alerts, and analytics tools. Features may change without notice.
4. No Medical or Wellness Claims
Content is not a medical device, diagnosis, treatment, therapy, psychological counseling, or wellness program. Consult a licensed professional for health decisions. Audio and charts are not offered as cures or treatments.
5. No Financial Advice
The Site does not provide investment, trading, or financial advice. Consult qualified advisors for financial decisions.
6. Audio Trial Limits
Web audio is promotional and may be time-limited (e.g., 60 seconds) via localStorage. Circumventing limits or abusing the feature is prohibited.
7. Schumann Resonance Pro App
The mobile Pro app is governed by app store terms, in-app purchase rules, and a separate end-user license. If these Terms conflict with store/app terms for the app, store/app terms may prevail for the app.
8. Accounts
Most features require no account. If accounts are introduced, you must provide accurate information and keep credentials secure.
9. Intellectual Property
Site design, text, software, logos, trademarks, UI, and original visualizations are owned by us or licensors. Tomsk/NOAA/NASA data remains subject to respective owners’ terms.
10. Limited License to You
We grant a personal, non-commercial, non-transferable, non-sublicensable, revocable license to access the Site and use features in accordance with these Terms. No right to source code, bulk data, or interface reproduction.
11. Prohibited Conduct
- Scraping, bots, crawlers, or bulk extraction of data/APIs.
- Reverse engineering or security testing without written permission.
- Overloading the service (DDoS, flooding, resource exhaustion).
- Malware, unauthorized access, harassment of others.
- Misleading health claims using Site content.
- Violating IP, privacy, or applicable law.
12. User Content
Feedback and messages you send grant us a worldwide, royalty-free license to use them to operate and improve the service and respond to you. Do not submit unlawful, defamatory, or infringing content.
13. Third-Party Links and Data
External links are for convenience. We are not responsible for third-party content, accuracy, or security. Live data may be delayed or erroneous.
14. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. DIRECT DAMAGES ARE CAPPED AT AMOUNTS YOU PAID FOR THE SITE IN THE 12 MONTHS BEFORE THE CLAIM, OR USD 100 FOR FREE USE, WHICHEVER IS LESS. MANDATORY CONSUMER RIGHTS REMAIN.
16. Indemnification
You will indemnify us against third-party claims, damages, and reasonable attorneys’ fees arising from your breach of these Terms or misuse of the Site.
17. Suspension and Termination
We may suspend or terminate access for violation, risk, or legal requirement, with notice where practicable. IP, liability, and indemnity sections survive termination.
18. Modifications
We may update these Terms. Material changes will be posted; continued use after the effective date may constitute acceptance.
19. Governing Law
These Terms are governed by the laws of the Republic of Turkey, excluding conflict-of-law rules.
20. Consumer Rights
Mandatory consumer protections in Turkey or your country of residence apply to the extent they cannot be waived in writing.
21. Dispute Resolution
Contact legal@schumannresonancelive.com first for good-faith resolution. Consumers in Turkey may use Consumer Arbitration Committees and Consumer Courts. For non-consumer disputes, Istanbul (Central) courts and enforcement offices have jurisdiction, subject to mandatory venue rules.
22. Severability
If any provision is invalid, the remainder remains in effect.
23. Entire Agreement
These Terms, together with the Privacy Policy, Cookie Policy, Disclaimer, and Legal Notice, constitute the entire agreement regarding use of the Site.
24. Assignment
We may assign our rights and obligations in a merger, acquisition, or asset sale. You may not assign without our consent.
25. Force Majeure
We are not liable for delay or failure due to events beyond reasonable control (natural disaster, war, epidemic, regulation, infrastructure or third-party source outage).
26. Survival
Sections on IP, disclaimers, limitation of liability, indemnity, governing law, and disputes survive termination.
27. Export Compliance
You may not use the Site in violation of export control or sanctions laws.
28. Class Action Waiver
TO THE EXTENT PERMITTED BY LAW, DISPUTES ARE BROUGHT INDIVIDUALLY; YOU WAIVE CLASS OR REPRESENTATIVE ACTIONS — SUBJECT TO NON-WAIVABLE CONSUMER OR EMPLOYMENT RIGHTS.
